Terms and Conditions

01. Scope of Services

LUNASWISS provides professional B2B sourcing, import/export, wholesale, and retail solutions across

a wide range of industrial and consumer goods. Our services include in particular:

Global sourcing and supplier verification

Import and export management, including customs clearance support

Wholesale distribution of industrial raw materials, semi-finished and finished products

Retail supply solutions for selected product categories

Logistics coordination, packaging, and quality inspections

These GTC apply to all services provided by LUNASWISS and form an integral part of all contractual

relationships, unless otherwise agreed in writing.

02. Contract Formation & Acceptance of GTC

A contract is concluded when:

LUNASWISS issues a written or electronic confirmation; or

both parties sign a supply agreement; or

the client makes payment for goods or services.

For online transactions, the client must actively accept these GTC (e.g. ticking a mandatory checkbox

"I have read and agree to the GTC"). For offline transactions, the order confirmation shall state that

these GTC are an integral part of the contract.

03. Product Descriptions and Pricing

Product descriptions in offers, websites, or brochures are non-binding and subject to availability.

All prices are in Swiss Francs (CHF) unless otherwise stated and are quoted EXW (Ex Works),

excluding VAT, duties, or shipping costs.

Prices may be adjusted in case of changes in raw material costs, supplier pricing, or exchange rates.

04. Payment Terms

Unless agreed otherwise, all goods and services are payable in advance.

Late payments may incur reminder fees and default interest of 7% p.a. (or statutory rate) plus

collection costs.

LUNASWISS reserves the right to suspend deliveries in case of non-payment.

05. Third-Party Suppliers

LUNASWISS collaborates with selected third-party manufacturers, logistics partners, and service

providers. While we assist in resolving issues, LUNASWISS is not liable for the performance or delays

caused by third parties.

06. Order Cancellations and Refunds

Cancellations must be submitted in writing.

Refunds depend on the status of order fulfillment and third-party commitments:

Prior to supplier confirmation: full refund minus admin fees (CHF 180 + bank charges)

Once goods are produced, shipped, or customized: no refund

Non-refundable costs (e.g., logistics, customs, special orders) always apply

07. Liability and Insurance

LUNASWISS is liable only for damages caused by intent or gross negligence.

Liability for slight negligence, indirect or consequential damages is excluded.

Maximum liability is limited to the invoice amount of the order.

The client is responsible for obtaining suitable transport, trade, or cargo insurance.

08. Compliance, Import/Export Regulations

Clients are responsible for ensuring that all products ordered comply with import, export, and

regulatory requirements in their jurisdiction.

LUNASWISS may perform reasonable compliance checks (e.g., sanctions, embargoes, KYC). Orders

may be declined if they violate applicable laws or sanctions.

09. Data Protection

LUNASWISS complies with the Swiss Federal Act on Data Protection (FADP) and, where applicable,

the GDPR. Personal data will be processed only to the extent necessary for sourcing, logistics, and

business transactions.

10. Intellectual Property

All product information, images, brand materials, and documents provided by LUNASWISS remain

the intellectual property of DigiHome Swiss AG or its licensors and may not be reproduced without

prior written consent.

11. Jurisdiction and Governing Law

These GTC are governed by Swiss law.

The exclusive place of jurisdiction is Zurich, Switzerland, to the extent permitted by law.

12. Miscellaneous & Updates

LUNASWISS may update these GTC periodically; clients will be informed via email or publication on

our website.

Continued use of services or placing new orders after notification constitutes acceptance of the

updated GTC.

If any provision is held invalid, the remaining provisions remain fully effective.

If published in multiple languages, the English version prevails.
